In the UK’s rapidly developing AI governance landscape, two institutions have taken a decisive and self-reflective step. The Judiciary of England and Wales and the Information Commissioner’s Office (ICO) have both published their internal policies on the use of artificial intelligence.

These are not external consultation papers or policy statements directed at industry. They are operational frameworks governing how public authorities themselves will use AI in their day-to-day work. That distinction matters. It marks the shift from talking about regulating AI to demonstrating how to govern it in practice.

These internal AI use guidelines provide a framework for understanding how AI can be effectively integrated while ensuring accountability and transparency. The necessity of clear ai use guidelines is paramount to ensure ethical and responsible usage across all sectors.

The Judiciary: AI as Administrative Tool, Not Judicial Assistant

The adoption of these AI use guidelines reflects a commitment to ethical AI application in the judiciary.

The Judicial Office’s AI Guidance for Judicial Office Holders (October 2024) recognises that AI tools — particularly large language models — are already being used by some judges and staff for drafting, research and administrative work.

However, the guidance draws a constitutional line: AI must not perform or influence core judicial reasoning. Judges remain the sole arbiters of fact, law and discretion.

The document highlights three core principles:

  1. Confidentiality – Judicial officers must not input sensitive or case-related material into generative AI systems unless the data is already public. Using cloud-based tools risks breaching confidentiality, a cornerstone of judicial independence.
  2. Verification and accuracy – AI-generated content must be verified. Outputs are to be treated as unverified secondary sources, not as authoritative legal material.
  3. Transparency – Any AI use in administrative or preparatory work should be capable of explanation and justification.

This approach embraces AI’s potential efficiencies while protecting impartiality and public trust in the justice system. It reflects the UK’s wider pro-innovation but accountable model of AI regulation.

The ICO: Practising What It Preaches

The ICO’s internal AI use policy, published alongside its Strategic Approach to AI Regulation (April 2024), is equally significant. As the UK’s data protection regulator, the ICO enforces responsible data processing across both public and private sectors. By setting AI governance rules for itself, it is applying its own regulatory principles in practice.

The policy sets out how ICO staff can use AI for tasks such as document review, investigation triage and data analysis — but always within a strict governance framework.

Key commitments include:

  • Lawfulness and purpose limitation – AI can only be used for defined statutory purposes within the ICO’s mandate.
  • Fairness and transparency – Users must be able to explain how an AI system supports or informs a decision.
  • Accountability – High-risk or sensitive use requires a Data Protection Impact Assessment (DPIA) and sign-off from the AI Governance Board.
  • Human oversight – AI tools can assist, but not replace, human regulatory judgment.

This mirrors the ICO’s message to businesses: compliance and innovation must go hand in hand, and accountability cannot be automated.

A Turning Point for Public Sector AI Governance

Both the Judiciary and the ICO are responding to the UK Government’s AI Regulatory Principles, set out in the DSIT’s White Paper on a Pro-Innovation Approach to AI Regulation and the February 2024 guidance to regulators.

The five principles — safety, transparency, fairness, accountability, and contestability — were designed for sectoral interpretation. What makes these two policies noteworthy is that both institutions have operationalised those values internally.

This shift is significant for three reasons:

  1. Cultural legitimacy – Public confidence in AI depends on the behaviour of institutions that use it. Courts and regulators modelling responsible AI use establish trust across sectors.
  2. Regulatory coherence – These policies align with similar approaches taken by Ofcom, the FCA and other UK regulators, ensuring consistent governance frameworks.
  3. Practical precedent – They show how abstract principles translate into action: governance boards, audit trails, DPIAs and human-in-the-loop safeguards.

From Policy to Practice

For organisations subject to UK regulation, these developments raise the bar. The “rules of responsible AI” are no longer theoretical — they are being embedded in internal operations.

Practical implications include:

  • Expect scrutiny of how AI tools are used in decision-making, not only whether they are used lawfully.
  • Maintain governance documentation: approval processes, oversight mechanisms, and audit records.
  • Recognise that “ethical AI” now extends beyond technical design to institutional culture and accountability.

The Bigger Picture

These steps also echo global trends. Under the EU AI Act (2024/1689) , public authorities face binding requirements for transparency and risk management when deploying AI. The UK’s lighter, principle-based model converges in spirit — both demand explainability, auditability, and clear human responsibility.

By defining how they will govern their own use of AI, the judiciary and the ICO are not just regulating others. They are showing what responsible AI governance looks like from the inside.

That example may prove to be the most powerful form of regulation yet.
